Partner Donna Aldea, head of the Appellate and Post-Conviction litigation group at BarketMarion, recently filed certiorari petitions before the United States Supreme Court on behalf of the Queens County District Attorney’s Office in two cases in which the NYS Court of Appeals ruled that the office’s program of interviewing suspects prior to arraignment violated their Miranda rights. Ms. Aldea handled the matters as special counsel to Queens District Attorney Richard Brown. You can see the full story from the New York Law Journal story here.

Donna Aldea, head of appellate and post conviction litigation at BarketMarion, recently secured the reversal of a criminal conviction and dismissal of the indictment against our client from a unanimous Appellate Division, Second Department. The client, Sasha Masri, had been accused of assaulting the mayor of Saddle Rock, NY, at Village Hall after a heated public meeting. Mr. Masri had been acquitted of felony charges after trial, but was found guilty of Attempted Assault in the Third Degree and sentenced to probation. The Appellate Division decision vacated that conviction and dismissed the indictment in it’s entirety.
